DIGITAL SUSHI MEDIA CC will here forth be referred to as Digital Sushi.

By accessing and using Digital Sushi you agree to the following terms:

Your usage of the website will not be for any purpose that is unlawful or prohibited by these terms and conditions.
By using this website you are fully accepting the terms, conditions and disclaimers in this notice.
Digital Sushi and its affiliates reserve the right to refuse service terminate orders or edit content in their sole discretion.

If you do not accept these Terms and Conditions, do not use this website.

2. Products on Digital Sushi Website - return to Index

Agreement of Sale

A sale, or order, is only valid once an order has been placed through the website and the payment verified in our bank account. Product pricing is only valid when an order is placed through the website, and not through email, telecommunications or any other form of communication.

Stock Availability

All products offered on digitalsushi.co.za are on offer for a limited period. When an item is out of stock, or no longer available, the item is no longer on offer. For more information on a product's stock availability please contact us.

Errors

Digital Sushi shall take all reasonable efforts to accurately indicate prices and delivery charges. However, should products be erroneously offered at incorrect prices and/or delivery charges, Digital Sushi will not be obliged to sell products at such incorrect prices and/or delivery charges and shall only be liable to refund monies paid should you not wish to proceed with the purchase at the correct price and/or delivery charge.

Prices

The price of each product is displayed with the product listing. In the event of a sale or special offer, the discounted price is displayed.

Delivery charges

The customer is responsible and liable for all delivery charges, unless otherwise stated.

Value Added Tax

Digital Sushi is currently not VAT regsitered and will therefore not charge VAT on any of its products.

Bank Charges

Digital Sushi will not be held liable or held responsible for any bank changes or other fees which may occur when using this website. For more information on bank charges please contact your bank.

First Pay, First Serve

Digital Sushi works on a "Pay first, serve first" system. This allows us to allocate stock, or process orders, which we receive payment for first. We cannot hold stock for any order that has not been paid for.

Credits (Transactions), gift vouchers and coupons

Digital Sushi retains the right to revoke any store credit, gift voucher or coupon issed in error, or obtained legally. Digital Sushi is not bound to fulfill any order placed with these payment methods.

If you feel a credit, gift voucher or coupon has been issued to you in error it is your responsibility to report it to Digital Sushi.

After sale discount

In the event that a discount is given to a customer after a sale has concluded. The amount will be issued as a store credit, and is not exchangeable for cash or a refund.

4. Payment Methods - return to Index

Electronic Funds transfer (EFT) and Bank Deposits

If "Manual Payment" is selected once the order has been placed you will be instructed on how to deposit the amount due into Digital Sushi's account.
The following criteria are to be taken into account:

The exact amount must be paid
User the order number as a reference when depositing the amount. If this is not done we will not be able to detect the deposit.
No transfers may be made from ATM's;
Cheque deposits are subject to a clearing period.;
No bank deposits are accepted from outside the borders of South Africa; and
Your order will be cancelled if you choose to pay by bank deposit and the amount due is not paid within 5 business days.

5. Deliveries - return to Index

Where we deliver

Digital Sushi only delivers to addresses within the borders of South Africa.

High-value items

Certain high-value items cannot be delivered to PO Box addresses. If this problem arises, Digital Sushi will contact you to make alternative delivery arrangements.

Orders, once you have been notified the product is ready for collection, may be collected from the following address:

Splitting Orders

If one, or more, of your items has arrived in a multi-item order we can split the shipment for you. For us to do this we will require that an addition shipping fee (R60 for courier / R65 for Speed Services) be paid in order for us to do so.

A reminder that no stock is kept on premises.

If a customer selects courier with a Postal Address, or vice versa, it is at Digital Sushi's descression on which shipping method to use.

6. Downloadable Products - return to Index

Download links and serial keys will only be made available once payment has been verified by Digital Sushi. This verification entails, but isn't limited to: credit cards successfully processed, EFTs/bank deposits reflected and cleared. This process will only take place during Digital Sushi's regular working hours.

Once the order has been process you may access your download by clicking on "Account" and "Downloads". All serial keys will be e-mailed you to for security purposes.

7. Products requiring a TV licence - return to Index

Any product classified by the SABC to require a TV licence will be done so. None of these devices will be sold to a user if a valid TV licence, and a copy of their ID, is not presented. Under SABC's rules we are bound by the following:

A retailer selling TV sets has the following reporting obligations to the SABC:

Ensuring that a prospective purchaser is in possession of a valid (paid-up) television licence prior to releasing a TV set;
Capturing a purchaser's personal particulars (ID number, address, contact details and television licence account number) in a Dealers' Register;
Forwarding such register to the SABC on a monthly basis;
Providing the SABC with an Annual Audited Statement reflecting the number of sets sold during the dealers licence year.

A copy of your ID and TV licence may be send to us via one of the following methods:

Please note: All TV licences and ID documents must be sent to us within 24 (working) hours of placing the order. No products will be ordered from our suppliers until we have verified these documents. If order that does not have the correct documents will be cancelled and refunded.

8. Product Returns - return to Index

A product may be returned under the following conditions:

If Digital Sushi has supplied the incorrect product based on the customer's order and / or specifications, Digital Sushi will exchange it for the correct item(s). Digital Sushi will cover the delivery charges and arrange for the collection and delivery of the item(s). This must be reported to Digital Sushi within ten (10) days of receiving the product. In some circumstances, dependant on stock levels, Digital Sushi may not be able to send out the correct product immediately.
If a product is materially faulty within six months, or DOA (Dead on Arrival), Digital Sushi will arrange collection of the item, if shipped via courier. The items will then be taken to our suppliers for testing, and at depending on the cause, replaced or the purchase price refunded, at the consumer’s discretion in accordance with the CPA. Should the item not be faulty due to a material fault, this clause will not apply.
A correctly supplied product that does not have a material defect may be returned for a refund, within seven (7) days of receipt of item, if it is in original condition (not opened or installed). The customer will then be liable for the return delivery charge. A restocking fee of 25% of the original purchased on orders returned after seven (7) days. Digital Sushi reserves the right not to accept returns later than 20 days from invoice. Any expenses handling charges relating to the return will be deducted from the refunded amount.
After having been supplied to, or at the direction of, the consumer, the goods have been partially or entirely disassembled, physically altered, permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within, other goods or property.
If opened the goods must be in a sellable / near perfect condition, which is up to Digital Sushi, or its suppliers' discretion.
The following products cannot be returned if opened, or used unless materially defective based on the suppliers' discretion:
- Consumable products, printer cartridges, blank/optical media and discs
- Software, PC games, console games, Mac games
- Gaming supplies, such as card sleeves
- CPUs - Central Processing Units
- Software licence keys
- Books, or literature
Used products may be returned at Digital Sushi's (and their supplier's) discretion. A return and re-stocking fee will be incurred. These fees will be 15% of the purchase value and the shipping amount paid originally.
Physical or structural damage is not covered by warranties or guarantees and any such damage invalidates the warranty. Determination of what constitutes physical damage is done by the supplier of the item.
All items must be returned with all their original packaging and accessories should the customer apply for a warranty refund.
Any goods containing serical numbers (i.e. PC components) must contain the original serial number on the unit, and match the unit. Any goods no longer containing their serial number will not be accepted.
If you are returning Goods via courier or post office please package it carefully so that it does not become damaged enroute. Please include the Returns Request Number and a copy of your original invoice with any return.
If an item is returned to Digital Sushi under the above terms, but is rejected by any means, as outlined above, the customer is liable for all delivery charges in order to receive the item back to the customer.

The image of the item not being the same as the item received does not constitute grounds for return. Images are for illustrative purposes only, and manufacturers and publishers are constantly changing the design of their products, and as such the appearance of the product is subject to change without notice.

If a product is deemed to be not faulty, or warranty void, the customer will cover the full charges of shipping the item back to the customer. Digital Sushi will inform the client upon rejection of the item.

All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Digital Sushi or otherwise used by Digital Sushi as permitted by law.
In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

Apart from the provisions of sections 43(5) and 43(6) of the ECT Act, neither Digital Sushi nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this Website or the services or content provided from and through this Website. Furthermore, Digital Sushi makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this Website are free from errors or omissions or that the service will be 100% uninterrupted and error free. This Website is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law and, subject to the 'Disputes' clause of these T&C, you and Digital Sushi submit to the non-exclusive jurisdiction of the South African courts.

Any person that delivers or attempts to deliver any damaging code to this Website or attempts to gain unauthorised access to any page on this Website shall be prosecuted and civil damages shall be claimed in the event that Digital Sushi suffers any damage or loss.

13. Hyperlinks - return to Index

Hyperlinks provided on this Website to non- Digital Sushi sites are provided as is and Digital Sushi does not necessarily agree with, edit or sponsor the content on such web pages.

14. Privacy Policy and Data Collection - return to Index

Digital Sushi may collect and store your Name and Surname, Email Address, Telephone number, Billing Address, Delivery Address and IP Address. This information will only be used for electronic communication between User and Digital Sushi, transactions, statistics and emails.
Digital Sushi will not disclose this information with any 3rd parties.

The above information may be given to our third party delivery companies for the strict usage of safe delivery of your order(s), and in order for them to contact you should there be a delivery problem.

Digital Sushi makes use of Google Analytics and as such some anonymous demographic data may be collected to help us make your shopping experience more enjoyable. For any further information on this please feel free to contact us. This data is not personally identifiable and we make no attempt to link it with the individuals that browse the site.

15. Pre-orders - return to Index

Product pre-orders fall under the following conditions:

Pre-orders may be combined with non-pre-order items, but will only ship according to the product with the longest shipping times.
Pre-orders may be split, but an additional shipping fee will apply.
Pre-orders with free shipping may be split, but the split order will require an additional shipping fee.
In situations where manufacturers release product in waves or partial quantities we will ship the oldest pre-orders first. Orders ship in the order that they are placed, i.e. oldest orders are shipped first.
All pre-orders require full payment at the time the pre-order is placed. If the customer wishes to change or cancel their pre-order before shipment, we will refund the full amount paid.
We reserve the right to cancel any orders for any reason at any time. If we need to cancel an order we will email the customer, but are under no obligation to obtain permission or acknowledgement, prior to cancellation.
Digital Sushi cannot be held responsible for suppliers short-supplying pre-order stock.
Digital Sushi cannot be held responsible for suppliers or manufacturers changing product release dates or shipping times.
